This Privacy Policy, Disclaimer, Limitation of Liability, and Terms of Data Usage (“Policy”) governs the collection, storage, processing, display, usage, sharing, retention, and protection of information submitted, uploaded, accessed, or otherwise made available through the Gonnet platform, website, QR services, applications, products, and related services (collectively referred to as the “Platform”). By accessing, using, registering on, uploading information to, scanning QR codes linked with, or otherwise interacting with Gonnet, you acknowledge that you have read, understood, and agreed to this Policy in its entirety. If you do not agree with any part of this Policy, you must discontinue usage of the Platform immediately. -------------------------------------------------- 1. DEFINITIONS -------------------------------------------------- 1.1 “Gonnet” refers to the Gonnet platform, its owners, operators, developers, affiliates, licensors, successors, administrators, employees, representatives, contractors, consultants, and service providers. 1.2 “User” means any person accessing, viewing, scanning, visiting, registering on, interacting with, or using the Platform in any manner whatsoever. 1.3 “Personal Data” includes any information capable of identifying an individual directly or indirectly, including but not limited to name, mobile number, email address, profile image, vehicle number, emergency contact information, QR-linked information, and any voluntarily submitted information. 1.4 “QR Profile” means a digitally accessible profile linked to a QR code generated through the Platform. 1.5 “Third-Party Services” include cloud providers, hosting providers, analytics tools, OTP providers, email providers, payment gateways, communication platforms, API providers, and all external services integrated with the Platform. -------------------------------------------------- 2. INFORMATION COLLECTED -------------------------------------------------- Gonnet may collect, receive, store, process, or display the following categories of information: a) Full name b) Mobile number c) Email address d) Vehicle registration number e) Emergency contact information f) Profile photographs or uploaded images g) Device information h) Browser information i) IP address j) QR scan activity k) Usage logs and analytics l) Technical metadata m) Communication records n) User preferences and visibility settings o) Any additional information voluntarily submitted by the User Users acknowledge that all information submitted by them is done voluntarily and at their own discretion. -------------------------------------------------- 3. PURPOSE OF COLLECTION -------------------------------------------------- Information may be collected and processed for purposes including but not limited to: a) Creation and management of QR-based profiles b) Display of user-selected profile information c) Emergency contact facilitation d) User authentication and verification e) OTP verification and fraud prevention f) Security monitoring and abuse prevention g) Platform maintenance and improvement h) Customer support and grievance handling i) Analytics and performance optimization j) Legal compliance and enforcement k) Investigation of misuse, fraud, abuse, illegal activity, or security incidents l) Communication regarding platform updates or services -------------------------------------------------- 4. USER-CONTROLLED DISPLAY OF INFORMATION -------------------------------------------------- Users understand and acknowledge that the Platform may publicly display certain information linked to a QR code when scanned. The visibility of certain information may depend upon: a) user-selected visibility settings, b) platform configuration, c) technical limitations, d) system functionality, e) caching, f) indexing, g) third-party integrations, h) browser behavior, i) device synchronization, j) screenshotting or copying by third parties. Gonnet does not guarantee that hidden, restricted, removed, modified, or deleted information will never become accessible, cached, archived, copied, screenshotted, indexed, or retained by third parties. Users are solely responsible for deciding what information they choose to upload, display, or associate with their QR profile. -------------------------------------------------- 5. CONSENT -------------------------------------------------- By using the Platform and submitting information, the User expressly consents to: a) collection of information, b) storage of information, c) processing of information, d) display of selected information, e) international transfer of information, f) cloud storage, g) automated processing, h) use of third-party service providers, i) communication regarding the Platform. Such consent shall be deemed informed, voluntary, unconditional, explicit, continuous, and revocable only to the extent permitted under applicable law and technical feasibility. -------------------------------------------------- 6. INTERNATIONAL STORAGE AND CLOUD PROCESSING -------------------------------------------------- User data may be processed, stored, backed up, cached, mirrored, or transferred through cloud servers and infrastructure located inside or outside India, including servers operated by third-party providers. Users acknowledge and consent that: a) international transfer of data may occur, b) data protection laws of foreign jurisdictions may differ, c) Gonnet shall not be liable solely because data is processed outside India. -------------------------------------------------- 7. THIRD-PARTY SERVICES -------------------------------------------------- Gonnet may utilize third-party providers for hosting, email delivery, OTP verification, analytics, security, payments, infrastructure, storage, monitoring, communication, customer support, or technical operations. Gonnet does not guarantee: a) uninterrupted functioning of third-party services, b) complete security of third-party systems, c) absence of outages, d) absence of data loss, e) uninterrupted availability. Users acknowledge that third-party systems may independently process data according to their own policies. -------------------------------------------------- 8. SECURITY DISCLAIMER -------------------------------------------------- Gonnet implements reasonable technical and organizational safeguards intended to protect information from unauthorized access, misuse, alteration, disclosure, or destruction. However, Users acknowledge and agree that: a) no digital platform is completely secure, b) internet transmissions are inherently vulnerable, c) hacking, cyberattacks, phishing, malware, data leaks, unauthorized access, system failures, outages, and breaches may occur despite reasonable safeguards. Accordingly, Gonnet makes no warranty or guarantee regarding absolute security of any information. Users use the Platform entirely at their own risk. -------------------------------------------------- 9. LIMITATION OF LIABILITY -------------------------------------------------- To the maximum extent permitted under applicable law, Gonnet, its owners, operators, developers, affiliates, employees, agents, contractors, licensors, successors, and service providers shall not be liable for any damages whatsoever arising out of use or misuse of the Platform. -------------------------------------------------- 10. NO WARRANTY -------------------------------------------------- The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind whatsoever. -------------------------------------------------- 11. USER RESPONSIBILITY -------------------------------------------------- Users are solely responsible for: a) accuracy of submitted information, b) legality of uploaded content, c) obtaining consent of emergency contacts, d) consequences of public sharing, e) use of generated QR codes. -------------------------------------------------- 12. INDEMNITY -------------------------------------------------- Users agree to indemnify and hold harmless Gonnet from claims, liabilities, losses, damages, and legal costs arising from misuse of the Platform. -------------------------------------------------- 13. DATA RETENTION -------------------------------------------------- Gonnet may retain information for operational, legal, technical, security, analytics, and backup purposes. -------------------------------------------------- 14. USER RIGHTS -------------------------------------------------- Users may request: a) correction, b) deletion, c) access, d) withdrawal of consent.
